Terms of Service

Welcome to Confide. These Terms of Service ("Terms") are a legally binding agreement between you and Confide, governing your access to and use of the Confide platform, including confide.gg, our desktop and mobile applications, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Confide.

Data Controller

Confide is operated from Germany. For legal and privacy inquiries, contact privacy@confide.gg.

Eligibility

You must be at least 16 years old to use Confide. By creating an account, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using Confide on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

The Service

Confide is an end-to-end encrypted communication platform for group messaging, voice communication, and file sharing. All user content, including messages, calls, and files, is encrypted on your device before transmission using post-quantum cryptography. The Confide server processes only ciphertext that it cannot decrypt.

Because of this architecture, Confide cannot read, moderate, search, filter, or recover your content. This is a fundamental design choice, not a limitation.

Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at privacy@confide.gg if you become aware of any unauthorized use of your account.

Your encryption keys are generated and stored on your device. Confide does not have access to your private keys. If you lose your device or credentials without a backup, your encrypted data cannot be recovered by anyone, including us. You are solely responsible for managing your encryption key backups.

Acceptable Use

You agree not to use Confide to:

  • Store, share, or distribute child sexual abuse material (CSAM) or any exploitative content involving minors
  • Share terrorist or violent extremist content, or recruit for terrorist organizations
  • Facilitate, plan, or promote criminal activity, including the sale of illegal goods or services
  • Distribute malware, ransomware, spyware, or any malicious software
  • Attack, probe, or attempt to compromise Confide's infrastructure or the security of other users
  • Impersonate Confide staff, other users, or any third party
  • Engage in spam, mass unsolicited messaging, automated account creation, or denial-of-service attacks
  • Harass, threaten, stalk, or incite violence against any individual or group
  • Violate the intellectual property rights of others, including unauthorized distribution of copyrighted material
  • Use the Service in any manner that violates applicable local, national, or international law

Violations may result in immediate and permanent account termination without prior notice.

Encryption and Your Responsibilities

All messages, voice calls, and files transmitted through Confide are protected by post-quantum end-to-end encryption. The server stores only ciphertext that cannot be decrypted by Confide or any third party. We cannot comply with content-specific legal requests because we do not have the technical ability to access your content.

You are solely responsible for the content you create, send, and share through Confide. End-to-end encryption protects the confidentiality of your communications, but it does not exempt you from applicable law. You remain legally responsible for your actions and the content you distribute, regardless of the encryption protecting it.

Intellectual Property

Confide and its original content, features, branding, and functionality are owned by Confide and are protected by applicable intellectual property laws. You retain ownership of any content you create and share through the Service. By using Confide, you do not grant us any license to your encrypted content, because we cannot access it.

The Confide name, logo, and associated branding may not be used without prior written permission. The open-source components of Confide are separately licensed under their respective open-source licenses.

Law Enforcement and Legal Requests

Confide may disclose limited metadata, such as account registration information, IP addresses from server logs (retained for up to 14 days), and guild membership data, when compelled by valid legal process issued by a court of competent jurisdiction, or when necessary to prevent an imminent threat to life.

We are technically unable to provide message content, voice call data, or shared files to any party, including law enforcement, because we do not possess the decryption keys. Any legal request for content that we cannot access will be responded to with a statement of technical inability.

Where permitted by law, we will make reasonable efforts to notify affected users of legal requests concerning their data before disclosure.

Self-Hosted Instances

Confide's server software is open source and may be self-hosted by third parties. Self-hosted instances are entirely independent from Confide. We have no control over, responsibility for, or liability related to any self-hosted instance, including its content, conduct, uptime, privacy practices, data handling, or compliance with applicable law.

When you connect to a self-hosted Confide server, you are using a third-party service that is not operated by us. These Terms do not apply to self-hosted instances. You should review the operator's terms of service and privacy policy before using their instance.

Service Availability and Warranties

We strive to maintain high availability but cannot guarantee uninterrupted or error-free access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or expectations.

Limitation of Liability

To the maximum extent permitted by applicable law, Confide shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Service, regardless of the cause of action or the theory of liability.

In no event shall Confide's total aggregate liability exceed the amount you have paid to Confide in the twelve (12) months preceding the event giving rise to liability, or fifty euros (EUR 50), whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or death or personal injury caused by negligence. Your statutory rights under EU consumer protection law remain unaffected.

Indemnification

You agree to indemnify and hold harmless Confide from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any applicable law, or your violation of the rights of any third party.

Account Termination

You may delete your account at any time through the application settings. Upon deletion, your account data is permanently erased in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or third parties, or is otherwise detrimental to the Service. You may appeal account actions by contacting privacy@confide.gg.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Germany and applicable European Union law. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Germany.

If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence. Your mandatory statutory consumer rights under the law of your country of residence remain unaffected by these Terms. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Confide regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to you via the application or your registered email address at least 30 days before they take effect. The "Last updated" date at the top of this page will be revised accordingly.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and delete your account before the effective date.
